Delaware filing outlines confidential binding mediation, potentially setting a mediator-determined price and ending the lawsuit

The legal fight between Phoenix Suns owner Mat Ishbia and two minority partners is expected to move into confidential binding mediation, per a new court filing submitted Monday in Delaware state court. If the judge approves the proposal, the case would be jointly dismissed, and Ishbia could be positioned to buy out Scott Seldin and Andy Kohlberg’s combined 13% stake at a price set by the mediator.

The dispute, filed in November 2025, had escalated to the point that it raised questions about Ishbia’s control position, with filings arguing his majority stake could be significantly diluted depending on how the operating agreement was applied.

If the buyout proceeds, Ishbia would remove the last remaining ownership holdovers from the Robert Sarver era and could increase his stake to roughly 96%, per ESPN’s reporting.
