Following an appeal, his assault-and-battery claim remained active.<\/p>\n<h2 data-section-id=\"uqpgm7\" data-start=\"2407\" data-end=\"2448\"><span role=\"text\"><strong data-start=\"2410\" data-end=\"2448\">Judge: &#8220;No evidence&#8221; of an assault<\/strong><\/span><\/h2>\n<p data-start=\"2450\" data-end=\"2622\">Judge Richard J.
